Fall through roof panel: Federal Court overturns foreman's acquittal
19/08/2026 · Federal Supreme Court · AG · Seriously injured · 6B_784/2025
What happened On the roof of a new building a worker broke through a non-load-bearing roof panel and fell about 2.5 m. There were no crawling boards or nets.
What the court decided Penalty order against the site foreman; acquitted by Zurzach District Court and the Aargau High Court (24.6.2025). The Federal Court upheld the injured worker's appeal and sent the case back – outcome open.
Why The Federal Court upheld the injured worker's appeal (on the indictment principle) and sent it back; the High Court must rule again.
- Site foreman: case open – Serious bodily harm by negligence, earlier sentence: 120 day-fines of CHF 220 (total CHF 26,400), suspended + fine CHF 5,280. Acquitted twice; the Federal Court quashed the acquittal. At the time there were no crawling boards or safety nets.
Even 2.5 m can cause serious injury: non-load-bearing roofs only with crawling boards or nets.
